I. Privacy Policy

This privacy policy governs the processing of personal data arising from the use of the website https://triple8.tv/, account.triple8.tv, upload.triple8.tv, editor.triple8.tv (hereinafter the ‘Website’) and the services offered on it.

II. Nature of data processing

In this privacy policy, the term «personal data» means information referring to users. It allows us to identify users, directly or in combination with other information in our possession.

III. Purpose of collection

That personal information and personal data are mainly collected, stored and processed for the following purposes:

  • to manage and improve the relationship between Triple8 and the user;
  • to enable the operation of the Website;
  • to be used in the context of managing the commercial relationship between Triple8 and the user; to
  • enable Triple8 to answer questions from users of the Website;
  • to enable Triple8 to send users publications, messages and information at their request; and
  • to enable Triple8 to comply with its legal and regulatory obligations, in particular in terms of security.

IV. Website users in general

Triple8 processes user data on the basis of consent. By using or consulting the Website, users explicitly consent to this privacy policy & general terms and conditions and consent to the processing of their personal data in relation to the purposes and methods described below. Providing data and therefore consenting to the collection and processing of data is optional. Users may refuse consent and may withdraw consent at any time. However, refusing consent may make it impossible to provide certain services and the browsing experience on the site may be affected.

V. Who has access to data?

Your personal data is shared only when you have a «free plan», but only for promotional purposes on our social media and Website. Some of our partners are located outside the European Economic Area. These partners are also considered individual controllers of your personal data and they bear individual responsibility for it. However, Triple8 has made arrangements with these partners to ensure that your personal data is processed appropriately.

We may transfer your personal data to a third party if we need to provide or share your personal data to comply with a legal obligation.

VI. How long do we keep your data?

Your personal data will be kept for as long as necessary for the purposes described in this privacy policy, or as necessary to comply with legal obligations and to settle (commercial) disputes. Files (in your profile) are kept either for 1 month or 3 months, depending on your subscription.

VII. Security

Triple8 will take all appropriate technical and organisational measures to protect your personal data against loss or unlawful use. We cannot guarantee the security of information sent to us via the internet.

VIII. Do you know your rights?

In case we actually process your personal data, you remain the owner of your data. Therefore, you have the right to:

1. Access and information
You can request information about data about you that we store and use. We are happy to answer any questions you may have. For this purpose, we may ask you for identification.

2. Erasure
You can request us to delete your personal data, unless we are legally obliged to store your personal data (e.g. for tax reasons). For this, we may ask you for identification.

3. Rectify
You can also request to rectify or supplement your personal data if you believe that the personal data we process is incorrect or incomplete. For this, we may ask you for identification.

4. Restrict
You may ask us to restrict the processing of your personal data if: a) the accuracy of the personal data is disputed by you; or b) the processing is unlawful, but you object to the erasure of the personal data (because you may want to have access to the personal data at a later stage) and you ask us to restrict the use instead; c) we no longer need your personal data for the pre- determined purposes, but you may need the data in the context of legal proceedings; (d) you have objected to Triple8’s processing of your personal data on the basis of your legitimate interest. During the period of your ‘objection’ and our assessment thereof, we will not process your personal data any further.

5. Objection
If we process your personal data as part of Triple8’s legitimate interests, you may object to further processing on this legal ground. Triple8 will take note of your objection and determine whether our legitimate interests outweigh your personal interests, rights and freedoms. In case we process your personal data for direct marketing purposes based on your legitimate interests, you can object at any time via the unsubscribe link in every newsletter you receive from us. We will then unsubscribe you as soon as possible.

6. Data transfer
In case we process your personal data digitally, you have the right to request a transfer of your personal data. We will provide you with a machine-readable file of your personal data that we have processed.

7. Withdrawing consent
You always have the possibility to withdraw your consent. Withdrawing consent does not affect the lawfulness of the processing before you withdrew consent.

If you wish to exercise the aforementioned rights and/or have other questions, comments and/or complaints, please contact our customer service department (see below) with your reasoned request. For this purpose, we may ask you for identification.

IX. Forwarding

By default, we process your data only within the European Union. We will only process your data outside the European Union if the country has an effective level of protection for your data.

Functional cookies

Analytical cookies
Our sites use analytical cookies set by Google Analytics to measure the number of visits as well as the parts of the sites that are most popular among users. This information is used to provide aggregated and statistical information about the use of our sites and is also used to improve the content of our sites to enrich the user experience. Furthermore, our sites use analytics cookies to measure how you found our sites, in order to measure the effectiveness of email campaigns, advertisements or AdWords on other third-party sites. The analytics cookies are linked to the personal data we store about you as set out above, to personalise our newsletters and for personalised ads on third-party sites.

However, Google may combine this data with generic data it holds about a user obtained through its other services. Therefore, Triple8 will only use Google Analytics with your consent. As Triple8 has no control over these services, please refer to Google’s information on its services.

In addition, Triple8 has entered into a processor’s agreement with Google. This agreement contains agreements between Triple8 (as responsible for the personal data) and Google (as processors of personal data). These agreements state for what purposes the acquired personal data may be used, what security measures must be taken and what forms of supervision Triple8 is allowed to exercise over this as responsible party.

Social media cookies
You may share parts of our sites on social media, such as Facebook, Twitter and LinkedIn. These social media use cookies to enable you to do so. Triple8’s Privacy and Cookie Policy does not apply to the use of such websites. Please refer to the Privacy and Cookie Policy of the relevant social media platform for information on their use of these cookies (Facebook/Twitter/LinkedIn).

Deleting cookies
Cookies do not store your data such as your e-mail address or telephone number, but usually process your IP address. If you do not want cookies to be stored on your computer or if you want to delete cookies that are already stored, you can control this through the settings screen in your browser settings. Adjusting these settings varies from one browser to another. The websites of the Dutch Consumer Organisation and all about cookies clearly explain how to arrange this. Please note that after the stored cookies are deleted, you will no longer be able to access the sites without accepting the cookies once more.

Sharing your information. How do we keep information secure?
We are grateful for the trust you place in us. Triple8 has taken every technical and administrative precaution to ensure that any information you send to us is secure. We are happy to sign an NDA (Non-Disclosure Agreement) or DPA (Data Processing Agreement) should that be required.

With us, all users choose a password, which they set themselves, to access their information. As a user, you are responsible for keeping your password confidential.

Amendments to this Privacy Policy

Triple8 may amend this privacy policy at any time at its discretion. When we do so, we will update the last update date at the bottom of this page. We encourage you to check this page regularly for changes to keep you informed of how we contribute to protecting the personal data we collect.
